Terms of Use

1. Acceptance of These Terms
This website, 18b.org (the "Site"), is operated by 18b The Las Vegas Arts District Neighborhood Association, a Nevada nonprofit corporation exempt under Section 501(c)(4) of the Internal Revenue Code (EIN 46-0510791) (the "Association"). Charitable programs and donations referenced on the Site are administered by 18b The Las Vegas Arts District Fund, a Nevada nonprofit corporation exempt under Section 501(c)(3) of the Internal Revenue Code (EIN 88-2654645) (the "Fund"). References to "18b," "we," "us," or "our" refer to both entities as applicable.
By accessing or using the Site, you agree to these Terms of Use and to our Privacy Policy, available at 18b.org/privacy-policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Site.
2. Intellectual Property
The "18b" name, the stylized 18b logo, the mark "18B THE LAS VEGAS ARTS DISTRICT," and all Site content — including text, graphics, photographs, videos, and design elements — are the property of 18b or are used with permission, and are protected by trademark and copyright law. A federal trademark application for the 18b mark is on file with the United States Patent and Trademark Office.
You may view and share Site content for personal, noncommercial purposes with attribution. You may not use the 18b name, logo, or marks in any manner that suggests affiliation, sponsorship, or endorsement by 18b — including in connection with events, merchandise, or promotional materials — without prior written permission from the Association.
Artwork displayed on the Site or in the Arts District remains the property of the respective artists. Nothing in these Terms transfers any artist's rights.
3. Acceptable Use
You agree to use the Site only for lawful purposes. You may not use the Site to transmit unlawful, harassing, defamatory, or infringing material; attempt to gain unauthorized access to the Site or its systems; interfere with the Site's operation; scrape or harvest data, including contact information of businesses or artists listed in the directory; or misrepresent your affiliation with 18b.
4. Donations
Donations made through the Site are received by the Fund, a 501(c)(3) public charity, and are tax-deductible to the extent permitted by law. Donations are processed by third-party platforms under their own terms of service. Donations are final. If you believe a donation was made in error or in an incorrect amount, contact us at [email protected] within thirty (30) days and we will review the request in good faith.
5. Events and Programs
The Site provides information about events and programs in the Arts District, some of which are produced by independent organizers, businesses, or partner organizations. 18b is not responsible for the conduct, cancellation, or content of events it does not produce. Event details are subject to change; confirm with the organizer before attending.
6. Directory and Third-Party Content
The Site includes a directory of, and links to, businesses, galleries, artists, and third-party websites. These are provided for community benefit and convenience. 18b does not control and is not responsible for the content, goods, services, practices, or privacy policies of any third party, and inclusion in the directory does not constitute endorsement. Your dealings with any third party are solely between you and that party.
7. Communications
Signup for our email and text message updates is governed by the consent language presented at the point of signup and by the Communications provisions of our Privacy Policy, including opt-out instructions.
8. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. 18b does not warrant that the Site will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the fullest extent permitted by law, the Association, the Fund, and their respective directors, officers, volunteers, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Site, reliance on its content, attendance at any listed event, or dealings with any third party listed on the Site. In no event shall the aggregate liability of 18b arising from these Terms or the Site exceed one hundred dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless the Association, the Fund, and their directors, officers, volunteers, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
11. Copyright Complaints
If you believe content on the Site infringes your copyright, send a written notice identifying the work, the allegedly infringing material and its location on the Site, your contact information, and a statement of good-faith belief that the use is unauthorized to [email protected] with the subject line "Copyright Notice." We will review and respond promptly.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any dispute arising from these Terms or the Site shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts.
13. General Provisions
Our failure to enforce any provision of these Terms is not a waiver of that provision. If any provision is held invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and 18b regarding the Site and supersede all prior agreements on that subject.
14. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page with a new effective date. Your continued use of the Site after revised Terms are posted constitutes acceptance of the revisions.
